Welcome to GhostMind. These Terms of Service ("Terms") govern your use of our website, [website URL] (the "Site"), and your purchase and use of our digital products (the "Products"). By using the Site or buying a Product, you agree to these Terms. If you do not agree, do not use the Site or buy Products.

The Site is operated by GhostMind, doing business as GhostMind ("GhostMind," "we," "us," "our").

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to buy Products. By purchasing, you confirm that you meet this requirement and can enter a binding agreement.

2. Our Products

GhostMind creates and sells digital educational and informational content about psychology, persuasion, behavior, influence, and self-development. Products are delivered electronically as PDFs, ZIP archives, or other digital files. We describe our Products in good faith but do not guarantee that a Product will meet your personal expectations.

3. Educational Purpose and Responsible Use

GhostMind content is created for education, awareness, and personal growth. It explains how psychology, persuasion, and influence work so you can better understand yourself and others and recognize when influence is being used on you.

You agree to use our Products lawfully and ethically. You may not use our content to commit fraud, harassment, coercion, stalking, abuse, or any other unlawful or harmful act, or to violate another person's rights. You are solely responsible for how you use what you learn and for the results of your choices.

4. Not Professional Advice; No Guaranteed Results

Our Products are for general informational purposes only. They are not medical, psychological, psychiatric, therapeutic, legal, financial, or other professional advice, and they do not create a professional relationship. They are not a substitute for care from a qualified professional. If you are struggling with your mental health, please contact a licensed professional or local emergency services.

Results vary. We make no promise that any Product will produce a specific outcome or benefit.

5. All Sales Final

All Products are digital and delivered immediately. Every purchase is final, and we do not offer refunds, returns, exchanges, or cancellations. By placing an order, you acknowledge that you have read and accepted our Refund Policy, which is part of these Terms.

6. Delivery and Download Limit

Delivery is governed by our Shipping Policy, which is part of these Terms. Each purchase includes five (5) downloads. You are responsible for saving and backing up your files.

7. License to Use Products

When you buy a Product, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use it for your own private, non-commercial purposes. You may store it on your own devices and print it for personal use.

You may not:

  • Resell, redistribute, share, sublicense, rent, lend, or give away any Product or any part of it, free or paid;
  • Post, upload, or host any Product or part of it on any website, file-sharing service, community, marketplace, or social platform;
  • Copy, modify, translate, or create derivative works from it;
  • Use any Product or part of it to train, fine-tune, or feed any artificial intelligence or machine-learning system, or to build datasets;
  • Remove or alter any copyright notices, watermarks, or identifiers; or
  • Use it for any commercial purpose without our prior written permission.

Purchasing a Product does not transfer ownership of the content or any intellectual property rights.

8. Intellectual Property

All content on the Site and in the Products, including text, graphics, logos, names, designs, and layouts, is owned by or licensed to GhostMind and protected by copyright, trademark, and other laws. You may not use the GhostMind name or marks without our written permission.

9. Piracy and Unauthorized Distribution

Unauthorized copying or sharing of our Products violates these Terms and copyright law. We may take any action available to us, including revoking your access without refund, sending takedown notices, and pursuing legal remedies. 10. Orders, Pricing, and Payment

  • Prices are shown on the Site and may change at any time without notice. The price at the time of your order applies.
  • Payments are processed by our e-commerce platform and its payment providers. We do not store your full payment card details.
  • You agree to provide accurate information and to pay all charges, including applicable taxes.
  • We may refuse or cancel any order, including for suspected fraud, pricing errors, or violation of these Terms. If we cancel an order, we will return the amount charged for it.

11. Chargebacks

Filing a chargeback or payment dispute on a delivered Product violates these Terms. We may submit evidence of your order, delivery, downloads, and acceptance of these Terms to your payment provider, revoke your access, and refuse future orders.

12. Use of the Site

You agree not to:

  • Violate any law or the rights of others;
  • Attempt to gain unauthorized access to the Site, our systems, or other users' information;
  • Interfere with the Site, introduce malware, or use bots or scrapers without permission; or
  • Use the Site to send spam or misleading communications.

13. Communications

If you give us your email address, we may send order-related messages and, where permitted or with your consent, marketing emails. You can unsubscribe from marketing at any time using the link in our emails.

14. Third-Party Services and Links

The Site may use or link to third-party services such as payment processors, email providers, and social platforms. We do not control them and are not responsible for their content, practices, or policies.

15. Disclaimer of Warranties

16. Limitation of Liability

To the fullest extent permitted by law, GhostMind and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site or Products. Our total liability for any claim relating to the Site or a Product will not exceed the amount you paid for that Product.

17. Indemnification

You agree to indemnify and hold harmless GhostMind and its owners, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Products, or your violation of any law or third-party right.

18. Termination

We may suspend or terminate your access to the Site, or revoke your license to any Product, without refund, if you breach these Terms. Sections that by their nature should survive termination, including licensing restrictions, intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

19. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information.

20. Your Legal Rights

Nothing in these Terms limits any consumer right that cannot be waived under the law where you live.

21. Changes to These Terms

We may update these Terms at any time by posting the revised version on the Site with a new "Last updated" date. Continued use of the Site or purchase of Products after a change means you accept it. The Terms in effect when you place an order apply to that order.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in the State of Illinois, and you consent to that jurisdiction. Before filing a claim, you agree to contact us at ghostmindofficial@gmail.com and try to resolve the issue informally.

23. General

  • Entire agreement: These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, are the entire agreement between you and GhostMind.
  • Severability: If any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver: Our failure to enforce a provision is not a waiver of it.
  • Assignment: You may not transfer your rights under these Terms. We may assign ours.
